The agreement between you and Persona Group governing your use of Persona - AI Dating.
⚠️ Important: These Terms contain a binding arbitration clause and class action waiver in Section 16. Please read them carefully. By using Persona, you agree to resolve disputes through individual arbitration rather than in court.

1. Acceptance of Terms
Welcome to Persona - AI Dating (the "App"), operated by Persona Group ("Persona," "we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Persona Group.
By downloading, installing, creating an account on, or otherwise accessing or using the App, you agree to be bound by these Terms, our Privacy Policy, our Community Guidelines, and all other policies incorporated by reference. If you do not agree to all of these Terms, do not use the App.
We reserve the right to update these Terms at any time. We will notify you of material changes via in-app notification or email at least 30 days before they take effect. Your continued use of the App after the effective date of revised Terms constitutes acceptance.
2. Eligibility
To use Persona, you must:
- Be at least 17 years of age (the App is rated 17+ on the Apple App Store);
- Have the legal capacity to enter into a binding agreement in your jurisdiction;
- Not be prohibited from using the Service under applicable laws;
- Not have been previously banned from the Service;
- Not be a convicted sex offender registered on any state, federal, or national sex offender registry.
By creating an account, you represent and warrant that all of the above statements are true. We reserve the right to request age verification at any time and to terminate accounts that do not meet eligibility requirements.
3. Account Registration & Security
- You must provide accurate, current, and complete information during registration and keep it updated.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You may not create more than one account, share your account with others, or transfer your account to another person.
- You must notify us immediately at support@persona-us.com if you suspect unauthorized access to your account.
- We are not liable for any loss or damage arising from unauthorized use of your account if you fail to safeguard your credentials.
4. Description of Service
Persona is an AI-powered dating application that uses on-device personality analysis to help users find compatible matches. The Service includes:
- Personality Profiling: On-device AI analysis of your personality quiz responses using the OCEAN (Big Five) model.
- Compatibility Matching: Algorithmic matching based on personality compatibility, preferences, and proximity.
- Messaging: In-app text and voice messaging between matched users.
- Wingman AI: An on-device AI assistant providing conversation tips and personality insights.
- Persona Premium: Optional paid subscription offering enhanced features.
We reserve the right to modify, suspend, or discontinue any feature or the entire Service at any time, with or without notice.
5. Acceptable Use Policy
You agree to use Persona in compliance with all applicable laws and our Community Guidelines. You must not:
- Harass, bully, stalk, threaten, intimidate, or abuse any other user;
- Post content that is hateful, discriminatory, sexually explicit, violent, graphic, or illegal;
- Impersonate another person or misrepresent your identity, age, photos, or affiliations;
- Use the App for commercial solicitation, advertising, spam, or pyramid schemes;
- Attempt to reverse-engineer, decompile, hack, or disrupt the App or its infrastructure;
- Collect, scrape, or harvest other users' personal information;
- Use automated scripts, bots, crawlers, or scrapers to access or interact with the App;
- Share content that infringes on any third party's intellectual property, privacy, or publicity rights;
- Solicit money, goods, or services from other users;
- Engage in or promote illegal activity, including drug trafficking, weapons sales, or human trafficking;
- Create accounts for anyone other than yourself;
- Use the App while under the age of 17;
- Circumvent any measures we use to restrict access to the App.
Violation of this Acceptable Use Policy may result in warning, suspension, or permanent termination of your account. See our Community Guidelines for detailed enforcement tiers.
6. User Content & Licenses
6.1 Your Content
You retain all ownership rights in the content you create, upload, or share on Persona ("Your Content"), including photos, bio text, messages, and voice notes.
6.2 License to Persona
By uploading or sharing Your Content, you grant Persona Group a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, display, and distribute Your Content solely for the purpose of operating, providing, improving, and promoting the Service. This license ends when you delete Your Content or your account, except:
- Content that has been shared with other users (messages, connection content) may persist in their experience until they also delete;
- Anonymized, aggregated data derived from Your Content may be retained indefinitely.
6.3 Content Representations
By posting Your Content, you represent and warrant that:
- You own or have the necessary rights and permissions to share it;
- It does not infringe any third party's intellectual property, privacy, or publicity rights;
- It does not violate any applicable law or regulation;
- Photos depict you and are not misleading about your identity or appearance.
6.4 Content Removal
We reserve the right to remove or disable access to any content that we determine, in our sole discretion, violates these Terms, our Community Guidelines, or applicable law. We are not obligated to monitor all user content but may do so at our discretion.
7. AI Features & Disclaimers
Persona uses on-device artificial intelligence to generate personality profiles, compatibility scores, and conversation insights. By using these features, you understand and agree that:
- AI-generated personality analyses are for entertainment and informational purposes only and are not professional psychological assessments;
- Compatibility scores are algorithmic suggestions based on the OCEAN personality model — they are not guarantees of relationship success or compatibility;
- AI processing occurs entirely on your device using Apple's Core ML framework — personality data is not sent to external servers or third-party AI services;
- We continuously improve our AI models and results may change over time;
- The Wingman AI assistant provides general communication suggestions, not professional relationship counseling or therapy;
- You should not rely solely on AI-generated insights when making decisions about personal relationships, safety, or well-being.
8. Subscriptions & Payments
8.1 Persona Premium
Persona offers optional paid subscription plans ("Persona Premium") that provide access to enhanced features. Current subscription tiers:
- Premium Monthly: Billed monthly at the price displayed at time of purchase.
- Premium Yearly: Billed annually at a discounted rate displayed at time of purchase.
8.2 Billing & Renewal
- All payments are processed through Apple's App Store via StoreKit 2. Persona does not directly handle payment credentials.
- Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
- Price changes will be communicated in advance. Continued subscription after a price change constitutes acceptance.
8.3 Cancellation & Refunds
- You may cancel your subscription at any time through your Apple ID account settings (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period.
- Refund requests must be directed to Apple, as they process all payments. Apple's refund policy applies.
- Deleting the app does not cancel your subscription. You must cancel through your Apple ID settings.
- No refunds will be issued for partial billing periods, except as required by applicable law.
8.4 Free Trial
If we offer a free trial, the trial period and terms will be clearly disclosed before you subscribe. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan at the displayed price.
9. Intellectual Property
The Persona app, including its design, code, AI models, algorithms, graphics, logos, trademarks, service marks, trade names, and all related intellectual property ("Persona IP") are the exclusive property of Persona Group or its licensors.
- These Terms do not grant you any right, title, or interest in Persona IP except for a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
- You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on any Persona IP.
- The "Persona" name, logo, and product names are trademarks of Persona Group. You may not use them without our prior written consent.
10. DMCA & Copyright Policy
We respect intellectual property rights and respond to notices of alleged infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and applicable international copyright laws.
10.1 Filing a DMCA Notice
If you believe your copyrighted work has been infringed on Persona, send a written notice to our designated agent containing:
- A physical or electronic signature of the copyright owner or authorized agent;
- Identification of the copyrighted work(s) claimed to have been infringed;
- Identification of the infringing material and information sufficient to locate it on our Service;
- Your contact information (name, address, phone number, email);
- A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
10.2 DMCA Designated Agent

10.3 Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our DMCA Agent including: (1) your physical or electronic signature; (2) identification of the material removed; (3) a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification; and (4) your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court in your district.
10.4 Repeat Infringers
We maintain a policy of terminating accounts of users who are repeat copyright infringers, in appropriate circumstances.
11. Safety & Reporting
Your safety is a top priority. We provide tools and resources to help keep you safe:
- Reporting: You can report any user or content that violates these Terms via the in-app ••• menu → "Report."
- Blocking: You may block any user at any time. Blocked users cannot see your profile or contact you.
- Review Process: Our safety team reviews all reports promptly and may take action including content removal, warnings, temporary suspension, or permanent bans.
- Law Enforcement: We cooperate with law enforcement agencies and may report illegal activity or threats to personal safety when required or permitted by law.

Emergency: If you or someone else is in immediate danger, contact your local emergency services (911 in the US) immediately. Persona is not an emergency service.
12. Termination & Suspension
12.1 By You
You may delete your account at any time via Settings → Delete Account. Upon deletion, your data will be permanently removed in accordance with our Privacy Policy. Deletion of your account does not entitle you to a refund of any subscription fees already paid.
12.2 By Us
We may suspend or permanently terminate your account, with or without prior notice, if:
- You violate these Terms, our Community Guidelines, or applicable law;
- Your conduct creates potential legal liability for Persona Group;
- Your account has been inactive for more than 12 consecutive months;
- We are required to do so by law or a court order;
- We discontinue the Service (with at least 30 days' notice if reasonably practicable).
12.3 Effect of Termination
Upon termination: (a) your license to use the App immediately ceases; (b) we may delete your data per our retention schedule; (c) provisions of these Terms that by their nature should survive termination will survive, including Sections 6, 9, 13–17, and 19.
13. Disclaimers
THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, PERSONA GROUP DOES NOT WARRANT OR GUARANTEE THAT:
- THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
- YOU WILL FIND A MATCH OR ACHIEVE ANY PARTICULAR OUTCOME;
- AI-GENERATED PERSONALITY INSIGHTS, COMPATIBILITY SCORES, OR RECOMMENDATIONS WILL BE ACCURATE, COMPLETE, OR RELIABLE;
- ANY CONTENT OR INFORMATION PROVIDED BY OTHER USERS IS TRUTHFUL, ACCURATE, OR CURRENT;
- THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
YOU ACKNOWLEDGE THAT PERSONA GROUP IS NOT RESPONSIBLE FOR THE BEHAVIOR, ACTIONS, OR OMISSIONS OF ANY USER, WHETHER ON OR OFF THE APP. YOU USE THE APP AND INTERACT WITH OTHER USERS AT YOUR OWN RISK.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- NO INDIRECT DAMAGES: PERSONA GROUP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
- AGGREGATE CAP: PERSONA GROUP'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PERSONA IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
- APPLIES REGARDLESS OF THEORY: THESE LIMITATIONS APPLY WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF PERSONA GROUP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Persona Group, its parent, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or access to the App;
- Your Content;
- Your violation of these Terms, our Community Guidelines, or applicable law;
- Your violation of any third party's rights, including intellectual property, privacy, or publicity rights;
- Any dispute between you and another user of the App.
16. Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
16.1 Agreement to Arbitrate
You and Persona Group agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App (including its formation, performance, and breach) shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as modified by this section.
16.2 Exceptions
Notwithstanding the above, either party may: (a) bring an individual action in small claims court for disputes within the court's jurisdiction; or (b) seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
16.3 Class Action Waiver
YOU AND PERSONA GROUP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims, preside over any form of representative or class proceeding, or award relief to anyone other than the parties to the arbitration.
16.4 Arbitration Process
- Before initiating arbitration, you must send a written notice of dispute ("Notice") to legal@persona-us.com describing the claim and your requested relief.
- If the dispute is not resolved within 60 days of receiving the Notice, either party may initiate arbitration.
- The arbitration will be conducted in the English language.
- For claims under $10,000, the arbitration will be conducted based on written submissions only, unless either party requests an in-person or telephonic hearing.
- The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
16.5 Arbitration Fees
If you initiate arbitration, Persona Group will pay all AAA filing, administration, and arbitrator fees for claims under $75,000, unless the arbitrator determines the claim is frivolous. For claims over $75,000, fees will be shared as set forth in the AAA Rules.
16.6 Opt-Out
You may opt out of this arbitration agreement by sending written notice to legal@persona-us.com within 30 days of first creating your Persona account. Your notice must include your name, Persona username or email, and a clear statement that you wish to opt out of arbitration. If you opt out, all disputes will be resolved in the courts specified in Section 17.
16.7 Severability
If the class action waiver in Section 16.3 is found to be unenforceable, then the entirety of this arbitration section shall be null and void with respect to such claim. If any other provision of this arbitration section is found to be unenforceable, the remaining provisions shall remain in effect.
17. Governing Law
These Terms and any dispute arising out of or related to them or the App shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
If arbitration does not apply (due to opt-out or inapplicability), you and Persona Group irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in Wilmington, Delaware, for the resolution of any disputes.
18. Force Majeure
Persona Group shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including but not limited to: natural disasters, pandemics, epidemics, acts of God, war, terrorism, riots, government actions, power failures, internet or telecommunications outages, cyberattacks, or failures of third-party service providers.
19. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, Community Guidelines, and any other policies incorporated by reference, constitute the entire agreement between you and Persona Group regarding the Service.
- Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights, except that Apple Inc. is a third-party beneficiary of these Terms to the extent required by the Apple Media Services Terms and Conditions.
- Headings: Section headings are for convenience only and do not affect the interpretation of these Terms.
- Notices: We may send you notices via in-app notifications, email, or by posting on the App. You may send us notices at the contact information provided in Section 20.
- Export Compliance: You agree to comply with all applicable export control and sanctions laws and regulations. You represent that you are not located in, or a national or resident of, any country subject to U.S. trade sanctions.
- Government Use: If you are a U.S. government user, the App is a "Commercial Item" as defined in 48 C.F.R. § 2.101 and is licensed under these Terms.
